Your Ability to Withdraw Funds

This policy applies to deposits into consumer accounts and, except where stated otherwise, to deposits into business accounts. It tells you when funds you deposit will be available for withdrawal. It does not tell you when interest begins to accrue on a deposit, which is a separate question answered in Section 5 of the Truth in Savings Disclosure, and the two answers are frequently different.

1. General policy

Our policy is to make funds from your cash and check deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits are available on the day we receive the deposit. Once the funds are available, you can withdraw them in cash and we will use the funds to pay checks you have written.

2. Determining the day of your deposit

For determining the availability of your deposits, every day is a business day except Saturdays, Sundays and federal holidays. If you make a deposit before the cutoff hour on a business day that we are open, we will consider that day to be the day of your deposit. If you make a deposit after the cutoff hour or on a day we are not open, we will consider the deposit to have been made on the next business day we are open.

The Signal Mountain office lobby opens at 8:30 a.m. on Fridays and at 9:00 a.m. Monday through Thursday. The cutoff hour is 4:00 p.m. on every day it is open.

3. Longer delays may apply

In some cases we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the second business day after the day of your deposit. The first $275.00 of your deposits, however, will be available on the first business day after the day of your deposit.

If we are not going to make all of the funds from your deposit available on the first business day after the day of your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the business day after we receive your deposit.

If you will need the funds from a deposit right away, you should ask us when the funds will be available. Asking at the counter costs nothing and is the only way to be certain.

3.1 Circumstances in which a longer delay may apply

In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

(a) We believe a check you deposit will not be paid.
(b) You deposit checks totaling more than $6,725.00 on any one day.
(c) You redeposit a check that has been returned unpaid.
(d) You have overdrawn your account repeatedly in the last six months.
(e) There is an emergency, such as failure of computer or communications equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the seventh business day after the day of your deposit.

4. Special rules for new accounts

If you are a new customer, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $6,725.00 of a day's total deposits of cashier's, certified, teller's, traveler's, and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions, for example the checks must be payable to you and you may have to use a special deposit slip. The excess over $6,725.00 will be available on the ninth business day after the day of your deposit. If your deposit of these checks is not made in person to one of our employees, the first $6,725.00 will not be available until the second business day after the day of your deposit.

Funds from all other check deposits will be available on the ninth business day after the day of your deposit.

5. Holds on other funds

If we cash a check for you that is drawn on another bank, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it.

If we accept for deposit a check that is drawn on another bank, we may make funds from the deposit available for withdrawal immediately but delay your availability to withdraw a corresponding amount of funds that you have on deposit in another account with us. The funds in the other account would then not be available for withdrawal until the time periods that are described elsewhere in this disclosure for the type of check that you deposited.

6. Deposits at automated teller machines

Funds from any deposits made at automated teller machines that we do not own or operate will not be available until the fifth business day after the day of your deposit. This rule does not apply at machines that we own or operate. All machines that we own or operate are identified as our machines by the Calder mark on the fascia and the surround.

7. Foreign checks

Checks drawn on financial institutions located outside the United States are not subject to this policy. They are handled on a collection basis, they are not credited to your account until we receive final payment, and collection can take six to eight weeks and occasionally longer. A collection fee applies whether or not the item is ultimately paid.

Nothing in this policy obligates the bank to make funds available earlier than the times stated. The bank may make funds available sooner than this policy requires in its discretion, in which case it has not amended this policy and has not committed to do so again on any later deposit.

The dollar thresholds in this policy are adjusted for inflation by the Consumer Financial Protection Bureau and the Board of Governors of the Federal Reserve System every five years. The amounts stated here took effect on July 1, 2025. If you are reading a printed copy issued before that date the amounts in it are superseded.

On the word “available”. Availability is not the same thing as finality. A check made available to you under this policy can still be returned unpaid by the paying bank afterward, in some circumstances weeks afterward, and when that happens we will charge the amount back to your account under the Deposit Account Agreement whether or not you have already spent the funds. Availability under Regulation CC is a rule about how long we may make you wait; it is not a representation that the item is good. This is the single most common misunderstanding raised with our Deposit Operations group, and it is the reason for the wording of paragraph 3.1(a).

On mobile deposit. The 8:00 p.m. cutoff hour for mobile deposit is later than the teller cutoff because the capture is processed in the evening clearing window. It is not a commitment to accept an item; a mobile deposit may be rejected for image quality, for a missing or defective endorsement, or because the item exceeds the mobile deposit limit on the account, and rejection may not be communicated to you until the following business day. Do not destroy the paper item until the deposit has posted and the funds have been made available. Retain it for at least 14 calendar days after that, then destroy it.
